Attorney General Jeff Sessions will be unable to prosecute state-compliant medical marijuana operations, if Department of Justice funding legislation approved by the Senate Appropriations Subcommittee on Commerce, Justice, Science and Related Agencies is passed into law. For the first time ever, this ban on spending federal funds to prosecute medical marijuana states has been included in the base language of the spending bill. Since 2014, this had been accomplished through amendments previously sponsored by Congressmen Dana Rohrabacher, Sam Farr, Earl Blumenauer, and others. Recreational marijuana operators are not protected by the language of the law, but the medicinal marijuana laws of 46 states, from those with whole-plant cannabis to those with low-THC cannabidiol oils, will be protected from DEA raids and other DOJ enforcement actions.
